How to Enter

To be eligible to win the promotion, entrants must, during the Promotional Period from 12.01am on Friday, 12 April 2024 to 12.01am on Friday, 31 May 2024 be members of the Foote’s Pharmacy Loyalty Club at a participating Foote’s Pharmacy business.

Terms and Conditions

Any information on how to enter the promotion and prizes received by the winners of the promotion form part of these Terms and Conditions. Participation in the promotion is deemed acceptance of these Terms and Conditions.

Entry is open to all Australian permanent residents who:
1. reside in Queensland, Australia;
2. are aged 18 years or older;
3. are members of the Foote’s Pharmacy Loyalty Club at a participating Foote’s Pharmacy business during the Promotional Period;
4. have a transaction recorded in the Foote’s Pharmacy Loyalty Club at any time between 12.01am on 1 March 2024 and 11.59pm on 31 May 2024; and
5. hold a current State or Territory driver’s licence.

Employees and Directors of the Promoter (and their immediate families) or of a Foote’s Pharmacy pharmacy or companies associated with this Promotion may enter the promotion but are ineligible to win the promotion. The Promoter reserves the right to exclude any entrant in its absolute discretion including if it deems an entrant to be unsuitable for participation in the promotion.

The participating Foote’s Pharmacy businesses are Foote’s Pharmacy Boonah, Foote’s Pharmacy Rosewood, Foote’s Pharmacy Walloon, Foote’s Pharmacy Leichhardt, Foote’s Pharmacy Grange Road, Foote’s Pharmacy Raceview, Foote’s Pharmacy Collingwood Park and Foote’s Pharmacy Redbank Plains.

Entrants must be able to collect the major prize from Llewellyn Motors located at 246 Brisbane Road, Booval in the State of Queensland or as otherwise specified by the Promoter.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who:

does not comply with these Terms and Conditions;
who tampers with the entry process;
has a prior criminal conviction, is the subject of an apprehended violence order or has any notation on a police record; or
has, in the opinion of the Promoter, engaged in conduct which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter.

Verification is at the sole discretion of the Promoter whose decision is final.

Errors or omissions may be accepted in the Promoter’s sole discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to verify the identity of the entrant.

The promotion commences at 12.01am on Friday, 12 April 2024 and closes at 12.01am on Friday, 31 May 2024. To be entered into the promotion, entrants must be members of the Foote’s Pharmacy Loyalty Club during the Promotional Period.

The total prize pool value for this promotion is AUD $27,790.00 as valued by the Promoter and the supplier, which is made up of seven (7) x $1,000 cash prizes and a major prize of a 2023 M.G. MY23 MG3 1.5 4AT Excite Sat Nav Automatic 5 Door Hatchback Motor Vehicle. Prizes, or any unused portion of a prize, are not transferable or exchangeable.

The first seven (7) valid entries randomly drawn from the Foote’s Pharmacy Loyalty Club system (operated by Know It All) will each win $1,000 cash. The eighth (8th) valid entry drawn will win the major prize of a 2023 M.G. MY23 MG3 1.5 4AT Excite Sat Nav Automatic 5 Door Hatchback Motor Vehicle including twelve (12) months registration, twelve (12) months compulsory third party insurance, dealer delivery charges and stamp duty.

Each random prize draw will take place at Foote’s Pharmacies Head Office located at 82 Grange Road, Eastern Heights in the State of Queensland. The first prize draw will occur at 10.00am AEST on Friday, 12 April 2024. Each subsequent prize draw will occur at 9.00am on each Friday thereafter for a total of eight (8) weeks. Winners will be notified by telephone and email within 24 hours of the draw.

All cash prizes will be paid by bank transfer to the winner’s nominated bank account. Payments will only be made to the account owned by the winner. Winner’s must provide the correct details for their nominated bank account and they will not be compensated if incorrect details are provided resulting in cash prizes being paid to the incorrect account.

Before any prize is rewarded, winners must present to Foote’s Pharmacies Head Office located at 82 Grange Road, Eastern Heights in the State of Queensland between 9.00am and 4.00pm on weekdays and provide evidence of their identity to the Promoter’s reasonable satisfaction in its sole discretion. Winners may also be required to provide any documentation which the Promotor and/or the Promoter’s suppliers reasonably request for the purposes of prize redemption.

If the major prize has been arranged for collection and a certain date/time, the winner must be available to collect the prize at that time. If the winner is unable to collect the prize at the time specified by the Promoter and/or the Promoter’s suppliers, they may be required to forfeit the prize.

The Promoter, in its sole discretion, reserves the right to substitute the prize or part of the prize with a prize to the equal value and/or specification subject to any written directions from a regulatory authority.

Entrants must be contactable by the Promoter to win a prize. If for any reason a prize is not claimed by the date which is three (3) months after the prize is drawn or the Promoter is unable to contact a winner by that date, the prize will be forfe There will be no unclaimed prize draw.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) disqualify any entrant or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion as appropriate.

In the event of war, terrorism, state of emergency, pandemic or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

Any and all costs associated with entering this promotion or accessing the promotional website or with redeeming a prize is the entrant’s responsibility

Except for any liability that cannot be excluded by law, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury or death or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not within the Promoter’s control), (b) any theft, unauthorised access or third party interference, (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter, (d) any variation to the prize value to that stated in these Terms and Conditions, (e) any tax liability incurred by an entrant or (h) any other reason arising in any way out of or in connection with the promotion.

Entrants indemnify the Promoter and its related entities against any claim, action, processing, loss or expense arising out of any liability for claims by a third party, or any claims they may have, caused by or in connection with their participation in the promotion or the acceptance of any prize. The Promoter has no ongoing liability to the entrant for any reason whatsoever.

Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law as well as any other implied warranties under the ASIC Act or similar consumer protection laws in Queensland.

As a condition of accepting the prize, the winners (and any companion/s) may be asked to sign legal documentation as and in the form required by the Promoter, prize supplier and/or organisers in their absolute discretion.

The Promoter collects personal information provided by entrants to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors and service providers, prize suppliers and as required, to Australian regulatory authorities. Entry and being selected as a winner of the promotion is conditional on providing this information.

The Promoter may, for an indefinite period unless otherwise advised, use information provided by entrants for promotional, marketing, research, profiling and publicity purposes, without any further reference, payment or other compensation to the entrant. Entrants should direct any request to access, update or correct information to the Promoter. By entering the promotion and opting in to the Foote’s Pharmacy Loyalty Club, each entrant agrees that the Promoter may use the entrant’s personal information in this way.

The laws of Queensland and Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Queensland and Australia.
